Health Care Fraud made easy.


This is presented in simple language that the average person will understand.

Sometimes the simple truth is complicated to others.

The great man Isaiah said it well :

They have eyes, but they don't see

They have ears, but they don't hear, and they don't understand.


Here is the simple truth.

Several definitions are listed but the easiest to understand are :

1. Fraud is a wrongful or criminal deception.

2. Fraud is a deliberate misrepresentation which causes a person to suffer

damages.

3. Fraud is an intentional deception.

4. Fraud is false representation of facts.

5. Fraud is willful or deliberate act to hide the truth.


The first example of Health Care Fraud which I posted yesterday,

August 20, 2011 is that of Dr. Peter E. Philbin.


Who is Dr. Philbin and what did he do ?

Dr. Peter E. Philbin is a Doctor of Medicine. The California Medical Board

has a record that Dr. Philbin is licensed to practice medicine.

The California Medical Board declared three days ago that the month of

September is Health Care Fraud montth. see :

It is important to establish that Dr. Peter E. Philbin committed fraud

beyond any reasonable doubt. Meaning we are sure and no doubt about it.

In Question and Answer form :

1. Was Dr. Philbin at the scene of the crimes ? Yes, Dr. Philbin was there.

2. Did anybody see Dr. Philbin ? Yes , Dr. Philbin was seen by ten persons.

These ten persons are eyewitnesses to the crimes.

3. Was Dr. Philbin a bystander or Did he just happen to be there ?

Dr. Philbin was an active participant in the commission of the crimes.

4. What was the event ?

It was a Judicial Review Hearing which was held according to Law in the City

of Vallejo in solano, County California.

5. What is meant by Dr. Philbin had an active role in the commission of crimes ?

The Hospital and Medical Staff prepared the Hospital documents presented at

the Judicial Review Hearing. They had at least six months to prepare for the

event or Judicial Hearing. These were also typewritten in a form that is

acceptable as material evidence for the Judicial or Legal proceeding.

The Hospital and Medical Staff had an Attorney. His name is :

Attorney Steven V. Schnier. He is the senior partner in the law firm of

Hanson Bridgett LLP, one of the largest law firms in San Francisco with

150 Lawyers in the group located on the 26th floor at

425 Market Street, San Francisco, California 94105.

6. What exactly did Dr. Philbin do ?

Dr. Philbin was presented by the hospital attorney, Attorney Steven V. Schnier,

as a Physician - witness for the Hospital and Medical Staff.

Dr. Philbin was like the spokesman or spokesperson for the Hospital and Medical

Staff. The Hospital is run by the Administrator and Board of Directors.

The Medical Staff, composed of about a hundred Physicians and Doctors, is run

by the Medical Staff Executive Committee composed of the elected officers of

the Medical Staff. They all operate under a set of Legal document or rules called

the Hospital Bylaws. So everything is legal or legit.

Supposedly yhey follow the hospital bylaws.

When their own hospital bylaws is Not followed by the hospital and Physicians

or Doctors, that is another crime.

When they conceal or hide or cover - up the truth, that is Fraud, it is a crime.

7. Was Dr. Philbin seen committing crimes ?

Yes, Dr. Philbin was seen committing crimes.

Yes, reliablr witnesses saw him.

First of all , Dr. Philbin was called to the witness stand by Attorney Schnier.

Dr. Philbin took the oath to tell the truth.

Dr. Philbin was seen and heard by the official court transcriber who produced

the 100 - page transcript of that Judicial Review Hearing. He was seen and

talked to the Hospital Attorney, Mr. Steven V. Schnier.

Dr. Philbin was seen by a doctor of Medicine who was a Pathologist.

Dr. Philbin was seen by other Doctors of Medicine whose specialties include :

Cardiology, Oncology, Hematology, and Internal Medicine.


8. The fraud of Dr. Philbin :


On page 47 line 10 , the hospital patient medical record was presented as

evidence. Dr. Philbin says : No Cardiology consultation on the patient.

On page 48 lines 1, 2, and 28 the accusation of Dr. Philbin is recorded.

On page 48 lines 11 and 12 , the statement of Dr. Philbin was proven false.

Dr. Philbin presented his evidence. the evidence, which was the hospital

patient medical record showed that there was a Cardiology Consultation.

The Cardiologist has a name and it was read.

Dr. Philbin convicted himself. How sad !!


The second example of Health Care Fraud was : Dr. Leonard A. Brant.

Dr. Leonard A. Brant is a Doctor of Medicine. He is a California - licensed

practicing physician.

The California Medical Board has the record that Dr. Brant has a medical

license to practice medicine. see :

Unlike Dr. Philbin whose case was just discussed, Dr. Brant is a Surgeon and

a Urologist. Dr. Philbin is taller while Dr. Brant is shorter in height.

Both of them have short hair, about one inch long. No moustache, No beard.

Their evil thoughts, lies, deceits, frauds, and falsehoods are presented here

for everybody to see and read.


Dept. of Justice did Not and does Not do anything.


What was said about Dr. Philbin is true or similar to that of Dr. Brant.


Similarities :


1. They are both Doctors of Medicine.

2. Both are practicing in California.

3. Both of them told lies, deceits, frauds, and falsehoods during the same

Judicial Review Hearing, held according to law in Vallejo, California 94589.

4. Both were Physician - witnesses in favor of the Hospital and Medical Staff.

5. Both were covered by the same Hospital and Medical Staff bylaws.

6. Both took the oath to tell the truth on the witness stand during the hearing.

7. Dr. Philbin and Dr. Brant both told lies, frauds and falsehoods.

8. Dr. Philbin and Dr. Brant both committed crimes.

9. Their crimes are found in the following :

A. California Criminal Code or Penal code :

Title 7 : Of crimes against Public Justice.

Chapter 5 Section 118 : Perjury.

Chapter 6 Section 234 : Fraud.

Chapter 8 Section 182 : Conspiracy.


B. Federal Civil Rights Act Title 18 Section 241 : Conspiracy.


10. Both Dr. Philbin and Dr. Brant were seen by nine ( 9 ) California-licensed

practicing physicians. Their crimes were instantly recorded by the official

court transcriber in the 100 - page transcript of the Judicial Review Hearing.


The testimony of Dr. Leonard A. Brant.

These were recorded instantly for posterity.


The testimony of Dr. Brant was shattered many times during the Judicial Hearing.

By his own admission in the transcript :

1. Page 82 line 2 : Dr. Brant said he was confused.

Therefore he is a confused witness.

To have a confused witness is Not good for the Hospital and the Medical Staff,

and the Hospital Attorney Mr. Schnier who was in charge, the masternind.

2. Page 82 lines 25 - 28 : It was pointed out that Dr. Brant was confused.

3. Page 83 lines 1 - 7 : It was pointed out that Dr. Brant misread things.

4. Page 83 line 5 : Dr. Brant said : " Yes, I misread things ".

5. Page 83 lines 6 - 7 : Dr. Brant made false statements, while under oath,

on the witness stand during the Judicial Hearing.


We call this Fraud , pure and simple.


6. Page 80 line 26 : Dr. Brant admits that he misread things.


7. Page 81 line 15 : Dr. Brant states under oath on the witness stand that

there was wrong interpretation of electrocardiogram ( EKG ).

8. Page 81 line 18 : Dr. Brant's statement was proven false when the

hospital patient medical record was presented as his evidence for what he said.

Dr. Brant was proven wrong and false by his own evidence.

Dr. Brant convicted himself.

When Dr. Brant realized that he was wrong and made a mistake,

Dr. Brant suddenly blushed !! His face turned red !! He was put to shame !!

Unfortunately, the transcriber did Not describe his face in the transcript.

9. Dr. Brant's testimony was false because the EKG was Not wrong.

The EKG was Normal. The main point was his testimony was FALSE.

Dr. Brant claimed a doctor read the EKG and the reading was wrong.

When the hospital patient medical record was presented, the EKG was read

by a different person. Not the one that he accused of doing the act.


In simple terms :


It is like Dr. Brant said : You broke my car in New York City, USA.

But the evidence showed that you were in Manila, Philippines !!

So, how can you do something in New York City when you were

12, 000 miles away in the Tropical isle in the Philippines ?


Of course, the Hospital and Medical Staff had to cover up this case.

They have to hide the facts !!

This should never come out in public.

What would the people say ?
