Health Care Fraud

Health Care Fraud involeves Lies, Deceits, Frauds and Falsehoods performed
by persons in the delivery of health care.

When a person is involved in Health Care Fraud, he or she calls on a a Lawyer
or Attorney for help.

Health Care Fraud made easy.

If you are a High school graduate, I believe you can understand what fraud is.

If you are a College graduate, like a Doctor or Lawyer, you understand better.

These frauds we are talking about involves Doctors and Lawyers and yet they
don't seem to understand.

Yesterday, August 19, 2011, I posted several definitions of Fraud.

To summarize :

1. F r a u d is a wrongful or criminal deception intended to result in financial

or personal gain.

2. A person or thing intended to deceive others, typically by unjustifiably

claiming or being credited with accomplishments or qualities.

3. F r a u d is a deliberate misrepresentation which causes another person

to suffer damages.

4. In Criminal Law, a fraud is an intentional deception made for personal gain

or damage to an individual. The related adjective is fradulent.

5. F r a u d is a false representation of a matter of fact ---- whether by words or

by conduct, by false or misleading allegations or by concealment of what

should have been...

6. F r a u d is defined to be " an intentional perversion of truth " or a

" false misrepresentation or representation of a matter of fact ."

7. F r a u d and related misconduct involves a willful or deliberate act or

failure to act with intention of obtaining an unauthorized benefit.


If more definitions or clarifications are needed , perhaps we should all go back

to High School.


Now, let us look at specific examples :

1. Dr. Peter E. Philbin.

Dr. Philbin is a Doctor of Medicine. He is a California - licensed practicing
physician. His specialty is Internal Medicine and Nephrology.

The accusation against Dr. Philbin is F r a u d.

The definition of Fraud was posted yesterday and today on :

Dr. Peter E. Philbin is accused of fraud which is telling lies, deceits, frauds and

falsehoods while under oath, on the witness stand, during a Judicial Review

Hearing which was held according to Law.

Held according to law means it was a legal proceeding, it was legit. It was Not

done in a corner, it was Not done in a parking lot of a Grocery Store, etc.

It was a Judicial Proceeding.

There is a record of the hearing before it starts. The hearing is instantly

recorded by an official court transcriber.

If you had watched on TV a show on investigation or prosecution or trial ,

the transcriber or a recorder is a lady or a man who sits in front and is typing or

recording what is going on or what is being said by a person at the start, the

middle and at the end of the Judicial Hearing.

There are persons present in the hearing. They are eyewitnesses to the events,

to who said what and these are in the transcript.

You can Not have a hearing by yourself.


How do we know that Dr. Philbin was at the Judicial Review Hearing ?

Dr. Philbin was at the judicial hearing because :

1. Dr. Peter E. Philbin was presented as a Physician - witness.

2. Ten persons ( nine doctors and one transcriber ) saw Dr. Philbin.

3. Dr. Philbin was seen by ten persons when he took the oath to tell the truth and

nothing but the truth on the witness stand.

4. Dr. Philbin did Not tell the truth. Dr. Philbin told lies, deceits, frauds and

falsehoods. This indicates Perjury or false testimony.

5. Dr. Philbin did not do this on his own. He had adviser, counsel or friend or

somebody who advised or cautioned or admonished him on what to say or Not

to say.

This indicates Conspiracy. He made false statements.

6. Dr. Philbin did not speak at the top of his head. Dr. Philbin had at least

six months preparation.

7. Dr. Philbin presented hospital patient medical records which were accepted as

material evidences.

In other words, Dr. Philbin produced the hospital patient records as proof or

evidence or to back up that what he is saying is correct or true.

8. The hospital patient medical record proved beyond any reasonable doubt

that Dr. Philbin told a lie, a deceit, a fraud. What Dr. Philbin said was opposite

of what was in the evidence or hospital record.

9. In simple terms that a High School student understands :

Dr. Philbin said you were in New York. The evidence showed you were in Spain.

10. The false statement made under oath on the witness stand was instantly

recorded by the official court transcriber and these are found in the transcript :

a. The statement of Dr. Philbin is on page 47 line 28 ; page 48 lines 1 and 2.

b. That his statement is proven false is also in the transcript : page 48 lines 11 -

to 12.

c. What Dr. Philbin did is in the California Criminal Code : Title 7

Chapter 5 , Section 118 : This is called Perjury.

Chapter 6 , Section 134 : This is called Preparing false document or paper.


Tomorrow I will present the lies, deceits, frauds, and falsehoods of

Dr. Leonard A. Brant.

Dr. Brant is also a California - licensed practicing physician. He was a

Physician - witness at the same Judicial Review Hearing and witnessed by

nine ( 9 ) California - licensed practicing Physicians.

His false statements are in the same transcript, different pages.

Question : Are Physicians reliable witnesses ?
